Ibn Taymiyyah (died 728H, rahimahullaah) stated: "The Khawaarij were the first ones to declare a Muslim to be outside the fold of Islaam due to his sins - rather to be precise, with what the Khawarij thought were sins! And they made lawful the spilling of the blood of the people of Islaam due to this."

In addition to deviantly pronouncing takfeer upon a Muslim who commits a major sin, the ignorance - and deviance and extremism - of the foolish-minded Khawaarij also leads them to make takfeer even upon those who actually implement the Sharee'ah.

What follows are two examples, both of which involve the noble Shaikh Ibn Baaz (d. 1420H, rahimahullaah):

Allaah's Messenger (sallallaahu 'alayhi wa sallam) said: Beware of al-Ghuluww (extremism) in the Religion, since those who came before you were only destroyed due to extremism in the Religion. [Ahmad (1/215, 347), Ibn Majah (no. 3029), an-Nisaa`ee (5/268), authenticated by Al-Albaanee in Silsilatul-Ahaadeethis-Saheehah (no. 1283), rahimahumullaah]

Shaikh Ibn Baaz, who was reviled and is still being slandered by the Khawaarij more than a decade after his death, brought proofs from the Qur`aan and Sunnah for his advice. From Ibn Baaz's many beneficial statements regarding this were:

"The fact that a peace treaty with the kuffaar - be they Jews or other than them - if it is called in order to attain benefit or because of need, then this does not mean affection or love for them, nor friendship and allegiance with them. Thus, when [the Prophet] (sallallaahu 'alayhi wa sallam) conquered Khaybar, he established a peace treaty with the Jews of Khaybar on the basis that they would take care of the palm trees and crops belonging to the Muslims, and half the produce would then be for them and the other half for the Muslims. So they continued upon that in Khaybar and he (sallallaahu 'alayhi wa sallam) did not lay down any time limit..."

"And the Prophet (sallallaahu 'alayhi wa sallam) established a peace treaty with the people of Makkah; and that did not mean that they loved them or took them as friends and allies, rather the enmity and hatred remained between them until Allaah made easy the conquest of Makkah in the year of conquest - and the people entered Allaah's religion in crowds. Likewise, the Prophet (sallallaahu 'alayhi wa sallam) established a peace treaty with the Jews of Madeenah when he emigrated to Madeenah - and it was not restricted by any time limit. So this did not necessitate love of them, nor affection for them. Rather, he (sallallaahu 'alayhi wa sallam) used to have dealings with them, speaking to them, calling them to Allaah, and encouraging them to enter Islaam."

"The peace between the leader of the Muslims in Palestine and the Jews does not mean that the Jews will permanently own the lands which they now possess. Rather, it only means that they would be in possession of it for a period of time until either the truce comes to an end, or until the Muslims become strong enough to force them out of the Muslim lands - in the case of an unrestricted peace. Likewise, it is obligatory, when we have the ability, to fight the Jews until they enter into Islaam or give the jizyah (a tax levied on those who are permitted to live under the protection of a Muslim state) in servility."

So not only are these statements/acts not kufr, nor are they major sins, nor any kind of sin, but rather they are from the Sunnah of the Messenger of Allaah (sallallaahu 'alayhi wa sallam)!

Imaam Al-Aajuree (died 360H, rahimahullaah) said: "Neither the scholars of old nor of new, ever differed about the Khawarij. They regarded them an evil people who were disobedient to Allaah and His Messenger even though they prayed, fasted and exerted themselves in worship, and all of this was of no benefit to them, even though they were apparent in enjoining the good and forbidding the evil, and that did not benefit them because they were a people who interpret the Qur`aan upon their desires."
